VIARA User Agreement and Terms of Use

Effective Date: 03.06.2026

This User Agreement governs access to and use of the VIARA assessment platform operated by Hexallt.

By registering for an account, purchasing an assessment, accessing the platform, or participating in a VIARA assessment session, you acknowledge that you have read, understood, and agreed to be bound by this Agreement.

1. Definitions

"VIARA" refers to the Vocational Integration and Role Adaptability Assessment platform.

"Platform" refers to all websites, applications, assessment interfaces, reports, services, and related technology operated under VIARA.

"Candidate" refers to any individual who registers for, purchases, accesses, or participates in a VIARA assessment.

"Assessment" refers to the structured behavioral evaluation process delivered through the VIARA platform.

"Report" refers to any score, summary, interpretation, recommendation, readiness indicator, or assessment outcome generated by the platform.

"Company", "We", "Us", or "Our" refers to Hexallt and its authorized representatives.

2. Eligibility

You may use VIARA only if:

  1. You are at least 18 years of age.
  2. You provide accurate and complete registration information.
  3. You are legally permitted to participate in professional assessment activities within your jurisdiction.
  4. Your use of the platform does not violate any applicable law or regulation.

3. Account Registration

You agree to:

  1. Provide truthful and accurate information during registration.
  2. Maintain the confidentiality of your login credentials.
  3. Ensure that your account is used only by you.
  4. Immediately notify us of any unauthorized use of your account.

You are solely responsible for all activity occurring under your account.

4. Assessment Access

Assessment access is granted only after successful registration and confirmation of payment.

Access may be denied, suspended, or revoked if:

  1. False information is provided.
  2. Fraudulent activity is detected.
  3. Platform integrity is threatened.
  4. This Agreement is violated.

5. Payment Terms

Assessment fees are payable in full before assessment access is granted.

All payments are processed through authorized third-party payment providers.

Unless required by applicable law:

  1. Payments are non-refundable once assessment access has been activated.
  2. Failure to complete an assessment after activation does not create entitlement to a refund.
  3. Payment processing charges, taxes, and third-party transaction fees may be non-refundable.

Any refund request remains subject to the Company's published refund policy.

6. Assessment Integrity

To preserve fairness and reliability, candidates must not:

  1. Share assessment content with any third party.
  2. Copy, reproduce, distribute, record, publish, or disclose assessment materials.
  3. Attempt to reverse engineer assessment logic or methodology.
  4. Use automated tools, bots, scripts, artificial intelligence systems, or other technologies to generate responses.
  5. Impersonate another individual.
  6. Allow another person to complete the assessment on their behalf.
  7. Attempt to manipulate platform behavior or evaluation outcomes.

Any violation may result in:

  1. Immediate assessment termination.
  2. Invalidation of results.
  3. Suspension or permanent restriction of access.
  4. Legal action where applicable.

7. Candidate Conduct

Candidates are expected to:

  1. Participate honestly and independently.
  2. Provide authentic responses.
  3. Follow all assessment instructions.
  4. Complete all responses without external assistance.

The Company reserves the right to investigate suspicious activity and review participation records where necessary.

8. Evaluation Methodology

VIARA uses proprietary assessment frameworks, behavioral evaluation methods, analytical models, and scoring systems.

The Company does not disclose:

  1. Internal scoring methodology.
  2. Assessment architecture.
  3. Evaluation mechanics.
  4. Classification logic.
  5. Behavioral interpretation models.
  6. Proprietary frameworks and intellectual property.

Participation in the assessment does not create any right to access these protected systems.

9. Reports and Results

Assessment reports are provided solely for informational and developmental purposes.

Reports:

  1. Reflect assessment outcomes at the time of evaluation.
  2. Do not guarantee employment.
  3. Do not guarantee immigration approval.
  4. Do not guarantee professional registration approval.
  5. Do not guarantee educational admission.

Employers, institutions, and candidates remain responsible for their own decisions and actions.

10. No Employment or Placement Guarantee

VIARA does not provide employment guarantees.

Assessment participation or qualification does not create:

  1. A job offer.
  2. A recruitment commitment.
  3. A placement agreement.
  4. A contractual relationship with any employer.

11. Intellectual Property

All platform materials, including but not limited to:

  1. Assessment content
  2. Scenarios
  3. Questions
  4. Reports
  5. Methodologies
  6. Frameworks
  7. Software
  8. Designs
  9. Documentation

remain the exclusive property of Hexallt and its licensors.

No ownership rights are transferred to candidates.

12. Privacy and Data Processing

The Company may collect and process:

  1. Registration information
  2. Identity verification information
  3. Assessment responses
  4. Session activity records
  5. Platform usage information
  6. Assessment outcomes

This information may be used for:

  1. Assessment delivery
  2. Identity verification
  3. Security monitoring
  4. Quality assurance
  5. Reporting
  6. Compliance obligations
  7. Platform improvement

Processing of personal information shall be governed by the VIARA Privacy Policy.

13. Data Retention

Assessment records, responses, reports, audit logs, and related information may be retained for operational, legal, security, compliance, quality assurance, research, and reporting purposes.

Retention periods may vary based on applicable legal requirements and operational needs.

14. Platform Availability

The Company does not guarantee uninterrupted or error-free access to the platform.

Temporary interruptions may occur due to:

  1. Maintenance activities.
  2. Security operations.
  3. Technical failures.
  4. Infrastructure issues.
  5. Network disruptions.
  6. Events beyond reasonable control.

15. Limitation of Liability

To the maximum extent permitted by law, Hexallt, VIARA, its officers, employees, contractors, affiliates, and partners shall not be liable for:

• Indirect damages.

• Consequential damages.

  1. Lost opportunities.
  2. Lost employment opportunities.
  3. Lost income.
  4. Immigration outcomes.
  5. Professional licensing outcomes.
  6. Educational admission outcomes.
  7. Reliance on assessment results.

Where liability cannot be excluded, total liability shall not exceed the amount paid by the candidate for the assessment.

16. Indemnification

You agree to indemnify and hold harmless Hexallt, VIARA, its affiliates, employees, officers, contractors, and representatives from any claims, liabilities, damages, losses, costs, or expenses arising from:

  1. Your misuse of the platform.
  2. Your violation of this Agreement.
  3. Your violation of applicable law.

17. Suspension and Termination

The Company may suspend, restrict, or terminate access without prior notice if:

  1. Fraud is suspected.
  2. Assessment integrity is compromised.
  3. Security risks are identified.
  4. This Agreement is violated.

Termination does not automatically create any refund obligation.

18. Modifications

The Company may update this Agreement from time to time.

Updated versions become effective upon publication unless otherwise stated.

Continued use of the platform constitutes acceptance of the updated Agreement.

19. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of India.

Any dispute arising from or relating to this Agreement shall be subject to the exclusive jurisdiction of the competent courts located in Kerala, India.

21. Acceptance

By creating an account, making payment, accessing the platform, or participating in a VIARA assessment, you confirm that you have read, understood, and agreed to this User Agreement and all related platform policies.
